PHOENIX (AZFamily) — The Arizona Supreme Court ruled Monday that the Arizona State Legislature does have a right to challenge Proposition 211, also known as the “Voters’ Right To Know Act.”
The “dark money” law aims to provide transparency involving contributions for campaign media spending and gives the Citizens Clean Elections Commission broad authority to enforce the law.
Opponents had argued that forced disclosure violates the Constitution and people’s right to free speech.
In the ruling, the state Supreme Court explained that the Arizona Constitution doesn’t have the same “case or controversy” requirement as the U.S. Constitution. And that the Legislature has shown it may suffer “if its lawmaking authority is improperly delegated.”
