The Rev. Richard Lott, who was a teacher at the Delbarton School in Morris Township, is accused of molesting a former student in 1976.
The judge presiding over the Delbarton sex abuse civil trial ruled that including the testimony of the defense's psychiatry expert witness would be "prejudicial" because he read from a report that the plaintiff's attorneys didn't have.
Psychiatrist Jacob Jacoby, an expert for the defendants, began to give testimony before the jury, but just before the lunch break, Michael Geibelson, the plaintiff's lead attorney, had questions about the document Jacoby was discussing.
Geibelson said the document was not given to the plaintiff's lawyers during the course of discovery and argued that the testimony should be excluded.
