FORT WAYNE, Ind. (WANE) - Charges were dismissed Friday for one of two men accused in a 2017 homicide.

Court records show Tavon Underwood, 27, no longer faces counts of murder and attempted robbery. The charges were dismissed without prejudice, meaning they could be refiled at a later time.

In 2017, police investigated reports of a hit-and-run and shots fired at a south Fort Wayne apartment complex. Nicholas Hennan, 36, was found dead from gunshot wounds in a car that had crashed into a tree.

Through witness accounts, police determined Ellis and another man allegedly shot at Hennan as his car crashed into the tree, according to Allen Superior Court documents.
