Prosecutors asked Thursday to withdraw a plea agreement for a 34-year-old man accused of dealing fentanyl to an Allen County inmate who overdosed and died.

Brian L. Boggs II of Fort Wayne has been charged with dealing in a controlled substance resulting in death, dealing a narcotic drug and two counts of possession of a narcotic drug. He pleaded guilty in January to the first two charges through a plea agreement that would limit his prison sentence to 25 years.

But prosecutors filed a motion to withdraw that deal because he isn’t cooperating with a related investigation, a requirement of the plea agreement. He said on a recorded jail call that he never intended to testify in the trial of 29-year-old Taylor D. Hunt, who is also charged with felonies for the inmate’s death.
