SYRACUSE, N.Y. (WSYR-TV)—State lawmakers are debating the PROTECT Act (S2282A). This bill would change the process between arrest and trial by adding a statewide risk assessment step before judges decide whether a defendant should remain in jail or be released.

The bill would require the use of a statewide risk assessment tool in all felony and Class A misdemeanor cases. Judges would review factors that could pose a risk to public safety. It would allow defendants to be held up to 48 hours while the assessment is complete.

It will also give judges the authority to factor in a person's criminal history, access to weapons, community ties, and likelihood of returning to court when deciding on release. Judges would then have to explain their decision on record.
