A tenured art professor at the University of South Dakota who sued USD and the South Dakota Board of Regents for issuing him an intent to terminate letter over his social media posts about the fatal shooting of conservative activist Charlie Kirk has moved to dismiss the lawsuit.

Phillip Michael Hook issued a notice of dismissal Oct. 6 after USD President Sheila Gestring sent him a letter Oct. 3 withdrawing the university’s intent to terminate his contract.

University officials considered Hook’s remorse for his original post calling Kirk a “ hate spreading Nazi, ” which he took down and publicly apologized for, as well as Hook’s past record of service and USD’s interest in efficient operations, as reasons to reinstate Hook, Gestring wrote in the letter.
