CLEVELAND — The City of Cleveland has filed a formal appeal challenging the Ohio Department of Transportation’s decision to approve a construction permit for the Browns’ proposed domed stadium in Brook Park near Cleveland Hopkins International Airport.

The appeal, filed on Oct. 3 by the City of Cleveland Department of Port Control in Cuyahoga County Court of Common Pleas, cites ODOT’s Sept. 18 decision to issue a permit with a waiver of obstruction standards under Ohio law.

The filing states the permit “is not supported by reliable, probative, and substantial evidence, and it is not in accordance with the law.”
