SIOUX FALLS, S.D. (KELO) -- A large sinkhole broke open in a Black Hawk neighborhood in 2020. Not long after, residents learned their homes had been built on top of an old, underground gypsum mine.
This morning, the South Dakota Supreme Court listened to arguments from residents' attorneys and the state.
The plaintiff's attorneys argue the state is liable because it damaged homeowner's property for public use. The state says the damage occurred when it still owned the property, and the developer was aware of the gypsum mine when it began to sell homes in the neighborhood.
