The Supreme Court, on Thursday, while ruling on a petition, stated that if a woman has frozen fertilised eggs (embryos) before 2022, she can be exempted from the age limit under the surrogacy law.

Justices BV Nagarathna and KV Viswanathan also reprimanded the government for citing increasing age as a cause for concern. The Court said, "the government cannot decide who can become parents". Because there is no age limit, even in the natural process.

Actually, this whole matter is related to the Surrogacy Law 2021, which came into effect in January 2022. According to the law, only men aged between 26-55 years and women aged between 23-50 years will be permitted for surrogacy.
