BUFFALO, N.Y. — The City of Buffalo has won a key legal battle against Cobblestone District building owner Darryl Carr.
In a unanimous ruling released Friday, the Fourth Department Appellate Division upheld an earlier decision blocking Carr from demolishing his vacant structures on South Park Avenue and Illinois Street.
The court agreed with Erie County Judge Sheila DiTullio, who found that Buffalo Housing Court doesn’t have the authority to issue emergency demolition orders for private property.
Carr had argued the century-old brick buildings were unsafe and beyond repair, seeking swift permission to tear them down. The buildings at 110 & 118 South Park Ave suffered monumental damage during a fire in June 2024.
