LOUISVILLE, Ky. (WAVE) - The City of New Albany is taking its fight over the removal of the Providence Mill Dam to the state’s highest court.

The City has requested that its dispute with Ecosystems Institute, LLC (ECI) and Indiana Department of Natural Resources (IDNR) be transferred to the Indiana Supreme Court. This comes less than two months after an Indiana appeals court affirmed a permit for the removal of the Providence Mill Dam, a structure that has been the subject of heated debate and lawsuits in the past few years.

When the permit was issued in 2021, the City of New Albany sued to block the removal.

Another legal fight resulted after the death of 14-year-old Andre Edwards, Jr., who drowned at the dam in 2024. The mayor placed rock fill without state approval at its base, and I
