A criminal defence lawyer has called the failed prosecution and ongoing suspension of a York Regional Police (YRP) officer that has lasted almost four years, “appalling.”

Const. Jordan Nesbitt was first charged with fabricating evidence by the force in April 2022 and was acquitted a year ago.

However, the 28-year-old from Durham remains suspended with pay despite the judge criticizing the Crown’s lead witness, a YRP officer himself, as “unreliable,” labelling his testimony as “astonishing” and “troubling.”

“The reasons to doubt PC Mac’s reliability and credibility are many,” Justice Jocelyn Speyer said in giving her verdict on his three charges, including breach of trust, fabricating evidence and attempting to obstruct justice in October 2024.
