The Nagpur bench of the Bombay High Court recently delivered a landmark verdict in a POCSO case, stating that even minimal penetration in a sexual offence against a minor amounts to rape. Noting further the court said that the minor’s consent holds no relevance in such cases.

The bench dismissed the appeal of a 38-year-old driver from Hinganghat in Wardha district, who was convicted of attempting sexual assault on two minor girls aged 5 and 6.

Justice Nivedita Mehta upheld the 10-year prison sentence and a fine of Rs 50,000 imposed on the accused.
