The federal appeals court in Cincinnati examined a narrow question in the case of Tyrone Noling . In doing so 14 years ago, it wasn’t in position to correct the glaring injustice that has found Noling on death row since 1996. Yet it made sure to register its dismay.

The court stressed that “serious questions have been raised regarding Noling’s prosecution.” Then, it added a humbling reminder: “As long as our justice system depends on men and women to make decisions, it will invariably make mistakes.”
