BISMARCK, N.D. (KMOT) – A Ray man who had state charges in a child sex crime investigation thrown out now faces a federal charge.

A grand jury indicted 57-year-old Gary Donnelly for receipt of child pornography earlier this month.

According to the indictment, the crimes took place between March and August 2022.

Donnelly faced charges in two separate cases filed in state court, one of which included 100 counts of possession of certain prohibited materials. However, the court granted a request from state prosecutors to dismiss both cases due to issues with the discovery of evidence.

As part of the federal indictment, Donnelly had to surrender to authorities two hard drives containing child pornographic material.

Donnelly was arrested on Tuesday and remains in custody in the Burleigh-Mor
