CLARKSBURG, W.Va. (WV News) — A 40-year-old Huntington-area man shot and killed in the wake of a police pursuit had brandished a gun during the pursuit, according to law enforcement.

He also had "produced a firearm towards the pursuing officers in a threatening manner," an affidavit filed by a state trooper attached to a drug task force alleges.

The affidavit was filed with Harrison Chief Magistrate Frank DeMarco, who found probable cause for a search of the area where the Huntington man was shot. The search warrant property receipt shows that a BB gun, 44 fired cartridges, nine fired bullets, a magazine, bullet fragments and pistol grips were among the items collected.
