A California appeals court denied Paul Flores’ appeal to overturn his murder conviction in the death of Kristin Smart, saying in an opinion released Friday that it found “no cumulative error” to grant a new trial.
Authoring the opinion issued by a three-judge panel, California Second District Court of Appeal judge Arthur Gilbert rejected Flores’ arguments that he didn’t receive fair trial due to improper jury instructions, the admission of uncharged sexual assault evidence and because the lower court failed to dismiss a biased juror.
“Flores contends cumulative error requires reversal or at least reduction to second degree murder,” Gilbert said. “There was no cumulative error here.”
