BISMARCK, N.D. (KMOT) – A Ray man facing a federal child pornography charge has been released to home confinement pending trial.

Earlier this week Your News Leader reported a grand jury indicted 57-year-old Gary Donnelly for receipt of child pornography.

The indictment states the crimes took place between March and August 2022.

Donnelly previously faced a series of similar charges in state court, but the courts agreed to dismiss the files due to issues with the gathering of evidence.

As part of his pretrial release agreement, Donnelly will be subject to electric monitoring. He will have to surrender his passport and not leave the state of North Dakota.

The agreement states he must not have contact with anyone under the age of 18 without prior approval, with the exception of his teen
