KOCHI: The Kerala High Court Division Bench has upheld a Single Bench verdict stating that there is no legal ban on collecting parking fees from the parking spaces in buildings such as shopping complexes. The Division Bench issued the order on an appeal challenging the Single Bench's earlier verdict, stating that it is legal to collect parking fees at Lulu Mall. The appeal was filed by a person named Bosco Kalamassery.
The Single Bench had observed that it is up to the building owner to decide whether to charge a parking fee or not. The Kerala Municipality Building Rules only require that adequate parking space be provided. They do not prohibit charging for it. The Division Bench has now upheld this decision.
