A judge has dismissed former Alabama Supreme Court Chief Justice Roy Moore’s defamation lawsuit against Beverly Nelson, who accused Moore of sexually assaulting her in Gadsden in the late 1970s when she was a teenager and he was a deputy district attorney.

Moore has adamantly denied Nelson’s story, which she first told publicly about 40 years after she says it happened.

Moore opposed Nelson’s motion to dismiss the case, saying the disputed facts should be argued in a trial.

Walker County Circuit Judge Gregory M. Williams, in a ruling issued Wednesday, granted Nelson’s motion for a summary judgment to dismiss the case.

Williams wrote that Moore’s motion opposing Nelson’s request for a dismissal failed to counter her claims with facts.
