BOISE, Idaho — The fifth defendant facing charges in an alleged illegal gambling operation at a horse racing track in Wilder entered a plea of not guilty in federal court Wednesday.

Dayana Fajardo was indicted by a grand jury on one count of prohibition of illegal gambling in connection with horse race betting.

Court documents alleged Fajardo helped take wagers and collected and paid gambling proceeds on race days at the operation.

During her hearing, Fajardo cried and smiled at family members sitting in the courtroom.

According to court records, Fajardo was not compliant with law enforcement during her arrest earlier this month. Police said she ran to a portable restroom, locked herself inside and disobeyed commands. Officers eventually pulled the door open, but police said it took
