The New Mexico Supreme Court will hold a non-jury trial in December to determine whether McKinley County District Attorney Bernadine Martin should be removed from office.

Special Master Alan Malott — a retired Albuquerque district judge appointed to hear pre-trial motions in the case — denied Martin's request Friday for an extension that would have given her 30 more days to respond to discovery requests, citing the "substantial public safety issues" at stake.

Martin — the state's first female Navajo district attorney, who was elected to her second four-year term in 2024 — faces the removal proceeding in connection with allegations she has "failed, neglected or refused to discharge the duties of her office," is incompetent or alternatively, has violated a rule that prohibits her from pri
