SIOUX FALLS, S.D. (KELO) – As Artificial Intelligence continues to evolve, people are excited about how it can be used to improve our lives. But there is also a dark side to AI. People are using it to make pornography.

Right now, in South Dakota, if someone were to take your picture off your Facebook account and use it to make AI pornography images, they might face at most a misdemeanor under state law.

Attorney General Marty Jackley wants to change that. Jackley says the arrest of a worker at the state driver's license office in Aberdeen amplifies the need for tougher laws.

Mark Charles Rathbun, 67, is charged with solicitation of rape, possession of child pornography and unlawful use of a computer system.

"The evidence has indicated that there is AI-generated adult porn," said Jackle
