The decision kicks the case back to U.S. District Court Judge Alvin Hellerstein, who in 2024 denied Trump’s second motion to remove the state case to federal court, in light of the last year’s U.S. Supreme Court decision broadening presidential immunity. "The district court did not grapple with any of the central issues," the appeals court wrote.
