WAWARSING, N.Y. — A lengthy investigation into the fatal 2022 state police shooting of Daniel McAlpin in Cragsmoor ended Friday with state Attorney General Letitia James’ decision that her office “would not be able to disprove beyond a reasonable doubt at trial that the officer’s actions were justified under New York law.”
McAlpin, 41, died on Sept. 9, 2022, after he was fatally shot by Trooper Jason T. Wurtz at the home he shared with his parents during an encounter with members of the state police and the Ulster County Sheriff’s Office.
