KANSAS CITY, Mo. -- A Jackson County judge has approved a $3.5 million wrongful death settlement against Kansas City Police Officer Blayne Newton. Money that will ultimately be paid by taxpayers.

For the first time, we’re hearing from one of the victim’s children.

Two people were killed, and another was shot in the head in the 2023 incident. Newton was never criminally charged.

Clay Gardner lost his mother, Kristen Fairchild that night. He says the payout means little compared to what was taken from him.

"It's nice to have it somewhat wrapped up almost – I can move on with my life but it doesn't change too much," Gardner said.

Two and a half years later, Gardner says he’s still heartbroken and frustrated that the same officer remains on the force.
