BOISE, Idaho — The City of Boise on Monday announced it has settled a federal lawsuit challenging the city's loitering ordinance.
Luke Schuchardt filed a lawsuit against the city in January 2024 following his arrest and prosecution after being stopped by officers with the Boise Police Department (BPD), according to the city's news release .
A federal judge ruled the ordinance unconstitutional as written.
A $200,000 settlement was reached due to the extensive litigation and merits of the case.
According to court documents, Schuchardt filed the lawsuit "to protect and vindicate his rights under the Fourth and Fourteenth Amendments of the United States Constitution."
