HOBBS, N.M. —
A New Mexico woman found guilty of reckless child abuse will be remanded back into custody after a newborn baby was found to be tossed inside a dumpster.

Alexis Avila appealed her conviction after arguing the jury was misdirected and not instructed on the defense of insanity. She was found guilty of tossing her newborn son into the dumpster in January 2022.
The New Mexico Supreme Court heard the arguments and made their ruling reaffirming the conviction of Avila on Monday, Nov. 17. The baby did survive the incident.
Avila was also convicted of attempted first-degree murder.
The appeal led to Avila being released in October 2023 shortly after being sentenced to 16 years in prison
