A South West WA man accused of rape and strangulation has been released on bail without a GPS tracking device, forcing his former partner into hiding in fear of her life, and raising questions about the state's electronic monitoring laws introduced last year.
Michael Robert Reynold Radomiljac is accused of raping and strangling his former partner, Kelly North, until she passed out.
The 47-year-old has pleaded not guilty to the charges and will go to trial.
On August 21, District Court Judge Seamus Rafferty granted him bail to live in Katanning, noting that he had "stayed out of trouble" for the past six years.
Ms North, who has given her permission to be identified, said she was "absolutely devastated" to learn that he had been released without a tracking device.
