BOISE, Idaho — An Idaho federal judge ordered the immediate release of some of the people detained by ICE during an FBI raid at a horse racing track in Wilder last month .
A lawyer with Ramirez-Smith Law, representing many of the detainees, told KTVB 15 people are being released in Idaho, eight of them from the Elmore County Jail. KTVB was on the scene Wednesday to witness detainees being reunited with their families.
Judge Winmill ruled Wednesday that the woman was unlawfully held at the Elmore County Jail and the Department of Homeland Security violated her rights to due process. Winmill said the Constitution guarantees due process rights to everyone on U.S. soil, regardless of immigration status.
