LANSING, Mich. — Michigan Attorney General Dana Nessel is warning discount retailer Five Below to correct alleged pricing issues after state inspectors found dozens of violations across stores statewide.

On Wednesday, Nessel issued a notice of intended action accusing the chain of repeatedly overcharging customers and failing to clearly display prices as required under Michigan law. The allegations cite violations of both the Michigan Shopping Reform and Modernization Act (SRMA) and the Michigan Consumer Protection Act.

According to the Michigan Department of Agriculture and Rural Development (MDARD), inspectors recorded 30 separate non-compliance findings at 18 Five Below stores between June 5 and Nov. 6, 2025. The chain previously told state officials it would audit pricing and retrain
