MINOT — It's unfortunate that generations worth of rancor over the legality of abortion in America has orbited around a legal fantasy, which is that somehow the law can say things it was never intended to say.

The Roe v. Wade decision, infamously, struck down state-based bans on abortions because a panel of judges decided the U.S. Constitution protects the right to an abortion, even though none of the authors of that document wrote a single word of it with the intent to create one. The U.S. Supreme Court correctly struck down Roe v. Wade and other relevant precedents years ago, pushing this legal battle back to the states, where proponents of legal access to abortion have continued the fantasy.
