Ten days before Luigi Mangione is due in state court for a suppression hearing, federal prosecutors have pushed back at attempts to rule out the death penalty.

A filing on Friday said that Attorney General Pam Bondi had "broad authority to determine when and how to prosecute" in the case, after a defense push to rule out capital punishment over Bondi's own public comments about the case, and commentary from other officials.

Mangione, 27, is facing charges after allegedly fatally shooting UnitedHealthcare CEO Brian Thompson, 50, on the streets of midtown Manhattan last December. He was charged with two federal counts of stalking, one count of murder through the use of a firearm, and one count of a firearms offense.
