A behavioral health operator filed a $3.4-million claim against Mesa after public complaints prompted the city to rescind its permission to open for business and required the facility to go through a more stringent approval process.
Legacy Recovery Center accuses Mesa of violating the Fair Housing Act and of “unlawful taking of vested property rights.”
“The City cannot comment on the pending litigation,” city spokesman Kevin Christopher said. Legacy Recovery CEO Richard Miller also declined to comment.
The city has 60 days to respond to the claim submitted Oct. 2. A claim is a precursor to a lawsuit.
