(Sioux Falls, SD) — A murder trial is moving forward following an attorney’s request in September to dismiss the case on grounds of self-defense. Timothy Overton is accused of shooting and killing a man at a parking lot in Tea in June 2024. The judge is allowing the case to move forward after determining Overton was engaging in criminal activity at the time of the incident. Overton’s defense team cited South Dakota’s Stand Your Ground Act as the reason for their motion to dismiss.
