DULUTH, Minn. (Northern News Now) - A Duluth man has been charged after illegally killing a moose while deer hunting.

It happened around 9:15 in the morning on Nov. 8, just a few hours after the deer firearms season officially opened in Minnesota.

The 38-year-old man told authorities he was up in his deer stand north of Cotton. He saw antlers and thought it was a deer, so he shot twice.

It ended up being a moose, which the DNR says was turned over to an 1854 treaty officer.

The state plans to seek a $1,000 restitution for the moose, which is set by state law.

The man is charged with illegally taking a moose, and could face an additional $3-thousand dollar fine, jail time, or both.
