UPDATE: The Tennessee Supreme Court has reinstated convictions against the former Hamilton County EMT and reserve deputy who killed a man in a 2018 wrong-way crash.
The ruling reverses a lower court's decision that "new evidence" was strong enough to partially vacate Justin David Whaley's convictions for vehicular homicide by intoxication and DUI.
Whaley was originally sentenced to nine years for causing the crash that killed James Brumlow in 2018.
His legal team petitioned for a writ of error coram nobis, essentially a "do-over" with facts that weren't available during the initial trial, as part of the appeals process in early 2024.
Whaley raised "multiple allegations of misconduct" against an officer on the scene. He also challenged the sufficiency of evidence presented, as wel
