The city’s top building official was so concerned about the safety of a dilapidated home owned by Mayor Andrea Horwath that he ordered it to be emptied of tenants and “imminently” demolished — but a judge has now rejected that emergency order.

Horwath is the registered owner of the home on West Avenue North, and the only tenant of the property is her former common-law partner, Ben Leonetti. A separate civil suit is underway between Horwath and Leonetti in relation to the state of the property.
