A Florida-based developer has taken legal action against Hillsborough and its planning board after the board rejected an application to construct two large warehouses in the municipality.

Homestead Road, LLC, the developer under contract to buy the property, filed the lawsuit in Somerset County Superior Court on Dec. 1.

The filing contends the township’s refusal of its proposal for warehouses of 368,995 and 168,304 square feet on Homestead Road near the Route 206 bypass was “arbitrary, capricious and unreasonable.”

The developer asserts the township engaged in “several actions aimed at hindering or obstructing” the progress of the application, which underwent more than 20 hearings over three years.
