The U.S. Supreme Court is expected to make a ruling in January 2026 in the case of a Brownsville death row inmate who was convicted of beheading his three children.

John Allen Rubio was sentenced to death in 2010 after being found guilty of killing his 2-month-old daughter Mary Jane Rubio, and his two step-children, Julissa Quesada, 3, and John E. Rubio, 1, in 2003.

In May, the Fifth Circuit of Appeals denied Rubio’s certificate of appealability, officially ending his last attempt to challenge his guilty conviction.

Rubio is now asking the Supreme Court to overturn that decision.
