WASHINGTON — A federal judge in Tennessee ordered Kilmar Abrego Garcia released from custody Wednesday, while a second judge in Maryland barred the Trump administration from immediately initiating proceedings to deport him to a third country.

U.S. District Judge Waverly Crenshaw upheld a magistrate judge’s ruling granting Abrego Garcia release on bond while he awaits trial on human smuggling charges in Tennessee. In a 37-page order, Crenshaw said the Justice Department had failed to convince him Abrego Garcia was a danger to the community or to back up its allegations that he’s a member of the MS-13 gang.
