ALBANY, N.Y. (NEXSTAR) — The Third Circuit Court of Appeals ruled that Mahmoud Khalil, a New York City resident arrested in March, will remain free from immigration detention while he legally challenges his removal from the country. The federal appeals court denied the Trump administration's request to send Khalil back to custody on Wednesday, affirming a lower court order for his release on bail.
The court decision also mostly rejected the government’s attempt to block the lower district court's injunction preventing Khalil's deportation on a disputed charge. While granting a partial, temporary hold on a single part of that injunction, the appeals court let most of it proceed.
