CLARKSBURG, W.Va. (WV News) — A 47-year-old Bridgeport woman will be sentenced Sept. 25 for felony driving under the influence of alcohol causing serious injury to a West Virginia Division of Highways worker.

Before taking Kiley Michelle Wagner's plea on Thursday, Harrison Circuit Judge Joseph F. Shaffer Jr. made sure that she understood that he has only two options in sentencing: To impose a prison term of 2 to 10 years, or to grant her home incarceration.

The statute takes probation and deferred adjudication off the table for this crime, Shaffer said.

Assistant Prosecutor James Armstrong, for Prosecutor Rachel Romano, will make no sentencing recommendation as part of the plea deal, the state's one concession in the case since Wagner pleaded guilty to the indictment.
