A Stanley man accused of beating his father to death with a metal pipe in 2024 was released from jail this week after prosecutors dismissed his first-degree murder charge, citing the need for further investigation by New Mexico State Police.
The First Judicial District Attorney's Office filed paperwork dismissing the case Tuesday against 38-year-old Carl Tune, and he was released Wednesday.
After reviewing the limited information state police provided about the case, prosecutors were "not in any position to proceed on pre-trial detention or preliminary examination," the dismissal document states.
