EUGENE — Daylen Austin ‘s legal Hail Mary is headed to review by the Oregon Supreme Court, which will allow the Ducks defensive back to play at least some — if not all — of the upcoming season.

Oregon Chief Justice Meagan Flynn granted a motion to delay Austin’s criminal trial, scheduled for Thursday in Lane County Circuit Court, Friday afternoon hours after a delay was denied by Circuit Court judge Bradley Cascagnette. The trial will be delayed until a decision from the state Supreme Court regarding a request by Austin’s attorney to review the motion to dismiss the indictment, which was denied earlier this week.

Petitions take 60 to 90 days to grant review and could take between three to 12 months after arguments, according to legal experts.
