MINOT, N.D. (KUMV) - A Surrey man accused of shooting and killing an Air National Guardsman in 2023 is taking a plea agreement.

Instead of murder, Daniel Breijo will plead guilty to manslaughter, lowering the crime from an AA felony to a B felony. He will also plead guilty to aggravated assault and reckless endangerment.

If accepted by the court, the agreement calls for Breijo to serve 20 years.

Prosecutors said Breijo fatally shot 41-year-old Nicholas Van Pelt and wounded another woman in a northwest Minot apartment complex on Christmas Eve 2023.

A motive, as well as the circumstances leading up to the shooting, have not been made public, though investigators have said Breijo and the victims knew each other.

A hearing date has not been set.
