BATON ROUGE, La. — A Baton Rouge judge has allowed a wrongful death lawsuit against Fred’s Bar and Grill to move forward over a outside the Tigerland venue.

As our partners at , the lawsuit, filed by Sheylli Pantoja on behalf of Devin Repath’s two sons, alleges that bartenders overserved both Repath and defendant Matthew Marsiglia and that security recklessly ejected the intoxicated, feuding patrons together, leading to the deadly fight outside.

Repath, 26, from Westwego, died from a traumatic brain injury after Marsiglia allegedly shoved him during the altercation. Marsiglia faces a manslaughter charge in a separate criminal case. The lawsuit also names the bar’s insurer, an unidentified server, a security guard, and another alleged participant, Vincent Leco, as defendants.
