A new rule was approved by the Washington State Supreme Court that allows judges to dismiss cases they decide are unjust, “The Jason Rantz Show” on Seattle Red reported July 22.
Former Senior Deputy Prosecuting Attorney at the King County Prosecutor’s Office, and now Instructor for the Washington State Criminal Justice Training Center, Scott O’Toole, believes Criminal Rule 8.3 “violates separation of powers” and “completely overrules the case law that’s been in existence for at least 40 years.”
“You don’t have to reason why this is a good idea, because there’s no case law that actually supports this. It’s just a brand new rule that we’ve now invented,” he said on “The John Curley Show” on KIRO Newsradio Monday.
He explained that Criminal Rule 8.3 gives judges more personal leeway.
