INDEPENDENCE, Mo. (KCTV) - Court documents filed Tuesday show that a wrongful death lawsuit has been dropped just over a year after a toddler’s tragic death.

Destiny Randle and Moses Bass filed a lawsuit against 728 N Jennings Rd Partners, LLC, in April 2025, approximately 9 months after their 3-year-old son, Tidus Bass, fell from a ninth-story window.

Randle and her boyfriend, Bass, were living in the Independence Towers apartments when Tidus fell through an open, unsecured window on July 29, 2024.

Tidus suffered devastating injuries and died in the hospital that day.

When he fell, Bass was reportedly out walking the dog. Randle said she was in one of the apartment’s bedrooms and thought the window was closed and secured.

They have since been charged with felony counts of first-degre
