A Burke County family filed a $25 million wrongful death lawsuit on the two-year anniversary of the death of a man shot by three Hickory police officers.

The lawsuit filed against the city of Hickory and the officers claims negligence, excessive use of force and wrongful death.

Timothy Craig Setzer Jr., 27, was shot and killed by Hickory police officers on Aug. 13, 2023, according to previous statements from the Hickory Police Department.

Hickory police said officers were responding to reports of shots fired in the 800 block of Fifth Avenue Southwest shortly after midnight. Callers said there was a white man walking around with a gun, according to a 2023 statement from Hickory police.
